Agreement to terms
By accessing or using the MyVirtualAgent platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and MyVirtualAgent Pty Ltd (ABN 00 000 000 000) ("MyVirtualAgent", "we", "us"). If you do not agree to these Terms, do not use the Platform. We may update these Terms from time to time and will notify you of material changes by email or in-platform notice.
Services
MyVirtualAgent provides an online platform connecting clients with MARA-registered migration agents. Our services include initial consultations, visa assessment, application preparation, and lodgement assistance. We are a technology platform that facilitates the delivery of migration agent services. All migration advice and assistance is provided solely by individual MARA-registered agents, not by MyVirtualAgent Pty Ltd as a corporate entity. The scope of services for each engagement is set out in a written service agreement provided before commencement.
Fees & refunds
Fees are quoted in writing prior to commencement of any paid service. Government visa application charges (VACs) are separate from and additional to our agent fees. Consultation fees are non-refundable once the session has been conducted. For full-application engagements, a refund may be available for portions of work not yet commenced, at our discretion. Refund requests must be made in writing to hello@myvirtualagent.com.au. We do not provide refunds where an application is unsuccessful due to circumstances beyond our control, including Department of Home Affairs decisions.
Limitation of liability
To the maximum extent permitted by Australian consumer law, MyVirtualAgent's liability to you for any loss or damage arising from your use of the Platform or services is limited to the amount you have paid to us in the 12 months preceding the claim. We are not liable for indirect, consequential, special, or punitive damages of any kind. Nothing in these Terms limits our liability where such limitation is prohibited by law, including under the Australian Consumer Law.
MARA Code of Conduct compliance
All agents operating through the Platform are required to comply with the Migration Agents Code of Conduct as prescribed under the Migration Act 1958 (Cth). MyVirtualAgent monitors compliance and may remove agents from the Platform for breaches of the Code. If you have a complaint about an agent's conduct, you may contact MyVirtualAgent in the first instance. If unresolved, complaints may be directed to the Office of the Migration Agents Registration Authority (OMARA).
Governing law
These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising out of or in connection with these Terms. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
